Jack - I am not sure but just offering an opinion. I guess my suggestion would be the safest way to conclude the transaction. There is still vat payable on services provided by the shipper which the shipper is responsible for but I guess the import taxes will always be for the importers account and the onus is on the importer to ensure that these are paid.
I am no expert but just offering an opinion so that we can try and make sense of why owners had to pay tax again. This opinion seems to be the only reasonable explanation.
Pretty much similar to this example: I use your motor vehicle and go through a speed trap trap @ 180kph. I give you the vehicle back and dissapear. The authorities go for the registered owner of this vehicle. I dont think the authorities will accept an excuse of "I wasn't driving" and the onus is on the registered owner to pay or prove otherwise.

It seems that there are too many aspects of this issue which are unclear(ie.what service was being provided? what form of tax is involved? etc etc) I will "wait and see" but quite intrigued to see the outcome.
What does seem to be true,is that the industry is rife with unpaid accounts,so credit control just seems to be another aspect to add to the long list of badly managed areas of this industry.
I wonder what will cause and kickstart the turnaround?

I am sure this post will get lost in the others but i think we can draw a line in the sand today and say this is the final nail in the coffin of racing SA and racing in general.
A lot of owners/stake holders are going to feel the fall out of this mess irrespective of who gets blamed at the end of the day.
Sad but RA with its 34% stake in Racing Listed entity is the one group that could make a difference but seem unable to or unwilling to save Racing to protect the ego' of a few heavy weights.

It would appear its only the lads on the Forum that are concerned about the future of Racing SA?
Hopefully we are mistaken and that plenty is happening behind the scene that we are not aware of and we are in good hands. :S

Guys, settle down for chrissakes!
This is not the final nail in the coffin by a longstretch.
It is a bump in the road.
Not a pleasant one, but nonetheless a bump in the road.
There are not enough people on this board that deal at the level of the big players in this game, so they really don't what they are writing or talking about.
There are, however, plenty of people that are late in paying trainers and vets because of generally slow times in the worldwide economy.
But to suggest the game is going down the tubes is a bit unrealistic at this time.

For Roux to claim a "lack of suitable accounting or financial skills" has got to be one of the sickest jokes of the year. Stealing from customers and SARS has got nothing to do with number crunching, it's about ethics, or in Roux's case a serious lack thereof.
Its very easy to come clean and ask the world for forgiveness when you get caught with your pants down but at the time he didn't seem too sorry to live high life whilst screwing his many customers and SARS. My view is that someone's character is tested when they're in the shit as well as when they're on top of the world. What did Roux do when he found himself in a hole, he lied to his loyal customers and effectively stole millions from SARS. How could he have gone cap in hand Kantor, Beck and co asking for dosh under false pretences? Its because he' a lying con artist who knew that if he owned up he would never get the money!
This is more than a mistake, it's disgraceful dishonesty for which there can never be an excuse. Also how can Roux use non paying clients as an excuse? Its like saying because someone stole from me I can steal from others! I would love to have someone a bet that this guy has done plenty people in over the years.
As Warren Buffet said, its all very well swimming in the sea of excess but when the tide goes back out to sea out you get to see who's been swimming naked!
Obviously I feel for his family but I'm a firm believer in if you do the crime, you gotta do the time and I hope he gets what's coming...

Herein some of the reasons why posters feel the need to discuss it on this forum. Far too much secrecy at all levels of the game. Lack of transparency is a sure fire way to get conspiracy theories and speculation going. Why shouldn't we discuss it and try figure it out. Its hidden under a veil of secrecy.
Our input in the game is no less important than the "bigger players" if you look at proportionate contribution to racing, income to spend. In fact I would guess proportionately some exceed income to spend of their wealthy "big players". If these allegations are completely true then I do not see any reason to worship these "big players". They seem to be dodgier than the tote "rif raff" and have a greater impact on the sport and society in general.
The whole industry operates like this with their clandestine deals etc and we expect the operator to act any different? More specualtion but it would leave one to guess that the whole industry is structured to protect the interests of a few.
I agree that the lot wont come tumbling down, but I do expect that some action will be taken against racing in general and perhaps some monkeys will fall out of the tree when SARS shakes it
The fish rots from the head down.
