Well then you should know the "reasonable man(expert) dictum" Would a reasonable commentator(expert/professional) call two races like the ones we've just heard? The answer in any court would be NO!

he is going over and beyond the call of duty, he obviously has a heavy cold, so as far as today is concerned its excusable. The court rules for the defendant and instructs the plaintiff, in this case Mr H, to accept that the commentator has made a few honest mistakes on the day and the matter should now rest.
